Troy Rafferty of Levin, Papantonio Selected for Team of Attorneys to Lead Actos Litigation

The Actos MDL (2299) is in full force. The Initial Status Conference will be this week on Thursday, March 22nd.  Judge Rebecca Doherty of the United States District Court, Western District of Louisiana has made her selections for the Plaintiffs’ Executive Committee and Steering Committee.  Judge Doherty selected Troy Rafferty to be part of the twelve-member Plaintiffs’ Steering Committee and announced this appointment on the Western District’s website last week.  You can view In Re: Actos (Pioglitazone) Products Liability Litigation (MDL 2299) announcements, orders, and other information on the MDL site: http://www.lawd.uscourts.gov/MDL2299/index.html

Actos bladder cancer cases have been abuzz since the drug was suspended from the European market and the FDA issued heightened warnings regarding bladder cancer concerns in the summer of 2011.  Since that time, litigation has developed on a national forefront in both state and federal forums.  The In Re: Actos (Pioglitazone) Products Liability Litigation MDL was created in December, 2011 and has made substantial progress as more bladder cancer cases are coming to light and filings are increasing around the country.  At her Initial Status Conference on Thursday, Judge Doherty has expressed intent to cover, among other things, the progression of discovery and ideas for the Case Management Order.  On Friday, initial planning sessions will take place among members of the Committees.
