Firm’s Verdict In Top List Publication
(Pensacola, FL) – The legal publication Top Florida Verdicts and Settlements of 2013 has included the trial victory of Pensacola attorneys Virginia Buchanan and Cameron Stephenson in the case of McCants v. Johns, which resulted in a $2.6 Million damage verdict on Aug 19, 2013. An Escambia County jury rendered the verdict in favor of the Estate of Nathaniel McCants, 7 years after McCants’ April 2007 death. In a case involving an on-the-job fire explosion, trial lawyers with the Levin Papantonio law firm, Virginia Buchanan and Cameron Stephenson, brought claims on behalf of the Estate against McCants’ job supervisor, Roy Johns, under a rarely used exception to the workers compensation law. The exception allows a claim when a supervisor engages in conduct that is virtually certain to result in injury to the employee where the supervisor misrepresents the risk to the employee and prevents the employee from making an informed choice about continuing with the work. The jury found that the supervisor hid a gas leak from Mr. McCants and other workers in order to move the construction project along.
