Court Approves Environmental Class Settlement in Spelter Case

SpelterIn a lengthy opinion setting forth the years of effort to obtain relief for the residents of Spelter, West Virginia, a trial court has approved a proposed settlement plan for contamination related to a nearby zinc smelter operation. Although DuPont fought the case for years, the court praised Class Counsel's efforts that finally brought the case to resolution. In this case, attorney Mike Papantonio, leading the Plaintiff's trial team, secured jury verdicts and judgments totaling over $300 Million, much of which was put in jeopardy by an appellate ruling that upheld most of the verdicts but ordered a new trial on some issues. The court's well reasoned opinion is must reading for anyone affected by the settlement or working in the area of Environmental Law.
